3.1 No Professional Advice

AI-generated outputs do not constitute professional advice.

3.2 Data Storage and Availability

Montra does not guarantee that any User Content or AI-generated outputs will be stored, preserved, or remain accessible.

4. Limitations

To the maximum extent permitted by law, in no event shall Montra Interactive Inc. or its suppliers be liable for any damages arising out of or related to your use or inability to use the Services.

5. Revisions, Service Changes, and Errata

We may at any time, without notice, make changes to the materials, update or replace models, workflows, or UI.

6. Refund Policy

All purchases of credits or subscriptions are final and non-refundable.

7. Monitoring and Analytics

Montra uses PostHog and other analytics tools to monitor and analyze how users interact with our Services.

10. Governing Law

These Terms are governed by the laws of Ontario, Canada.

11. User Content and AI-Generated Media

By uploading content or using our Services to generate outputs, you represent and warrant that you have all necessary rights to such content.

11.1 License to Montra

You grant Montra a worldwide, non-exclusive, royalty-free, sublicensable license to use your User Content solely for operating, improving, and promoting the Services.

11.2 Real Person Content in Marketing

Montra will not use content depicting real identifiable individuals for marketing without explicit consent.

11.3 AI Generated Outputs and User License

Montra does not claim ownership over AI-generated outputs you create.

11.4 Disclosure Requirement for Synthetic Media

You must clearly disclose that AI-generated media depicting real people is synthetically generated.

12. Prohibited Use and Content Policy

You agree not to use the Services to create content that involves sexual/explicit content, hate/harassment/abuse, violence/self-harm/extremism, or other prohibited uses.

13. AI Model Use and Limitations; Platform Role

Our Services integrate third-party and proprietary AI models. These may produce inaccurate, biased, or unexpected outputs.

14. Fair Use and Abuse Prevention

Excessive or automated usage may result in throttling, account suspension, or termination.

15. Copyright Complaints and DMCA Compliance

Montra complies with the DMCA. Submit notices to hello@montra.com.

16. Account Responsibility and Access

You are responsible for maintaining the confidentiality of your account credentials.

17. Credit Expiration and Billing

Credits expire 30 days after issuance. Unused credits do not roll over.

18. Third-Party Services and Dependencies

Montra integrates third-party services including GCP, AWS, Fal, Anthropic, ElevenLabs, Vercel, and others.

19. Export Control and Sanctions Compliance

You agree to comply with all applicable export control laws and trade sanctions.

20. Beta Features and Experimental Tools

Beta Features are provided “as is” with no guarantee of stability.

21. Indemnification

You agree to fully indemnify, defend, and hold harmless Montra Interactive Inc.

22. Termination of Services

We reserve the right to suspend or terminate the Services at any time.

23. Feedback and Suggestions

You grant Montra a perpetual, irrevocable, royalty-free license to use any Feedback.

24. Severability and Entire Agreement

If any provision is found unenforceable, the remaining provisions remain in effect.

25. Dispute Resolution and Arbitration

Disputes shall be resolved through binding arbitration in Ontario, Canada. You waive the right to participate in class actions.
